Terms & Conditions

Estimations

Unless otherwise stated, the estimate is valid for 30 days from the date of production. The price is based on the information given by the supplier(s) and Customer at the time of pricing the work.  Any changes in the cost of materials and supply of materials between the date of contract and the delivery of the services are beyond the control of Creative Star Ltd, and may increase and decrease accordingly in price. 

Access

The customer is required to make parking available within reasonable walking distance from site for Creative Star Ltd to move tools and materials easily. If metered parking is in place, the cost of this will be added. You agree and understand that access to site must be provided between 8am and 4pm Monday through to Friday for the duration of the job. If at any time access is not available to the Creative Star Ltd for any reason you agree to reimburse expenses incurred for travel, materials and lost time.

It is the client(s) responsibility to move all and any household furniture and personal items from the area in which Creative Star Ltd is to carry out work (with the exception of large items such as sofas and beds) and to store these items away from the work area and for the duration of the work. We will not remove or take down curtains or blinds and in the event that the customer leaves such items in the work area then such items shall be left at the Clients own risk. We will not be held liable for any damage to items not removed from the work area. Large items shall be covered. We will not be held liable for damage to any items removed by us or covered for the duration of the works.

Electric, water and storage 

The Customer will be expected to provide electric power, running water and toilet facilities where reasonably possible. Brushes may need to be washed on site, due care will be taken if done so. 

Creative Star Ltd may request that tools and materials be left at the home/site during the works. The Customer reserves the right to decline such a request. At no point must the Customer use any equipment belonging to Creative Star Ltd. 

Materials 

All materials needed to undertake the work that has been agreed will be provided by Creative Star Ltd, unless otherwise agreed. We will ensure that all materials will be of the highest trade quality to insure that the work can be completed to the highest standard. Always following the manufactures guidelines. Creative Star Ltd cannot take responsibility for faulty products or paint failure on horizontal surfaces or any surface that permits moisture to collect because of their specific design (i.e. railings, porches, wooden gutters, decks, stairs, roofs, etc.). Creative Star Ltd cannot guarantee the performance and quality of the materials provided by the Customer. 

Creative Star Ltd will not decorate any surface that we have good reason to suspect is asbestos. In the event of asbestos being found then the Customer will require to instruct a qualified specialist.

Waste Removal

Creative Star Ltd does not have a waste removal license with Wiltshire County Council. Therefore can not remove any waste related to the works. All waste will be kept to a minimum and put into rubbish bags for the Customers disposal. On projects with a lot of waste, a skip will be supplied within an estimate.

Retention of title

Where the Customer has not paid for any products in its possession, the property of such products shall remain with Creative Star Ltd. The products shall be held by the Customer as bailee; and title in the products shall remain with Creative Star Ltd until the Client has made payment for the products.

The Customer gives irrevocable authority to Creative Star Ltd to enter any premises occupied by the Customer, at any reasonable time, to remove any products not paid for in full by the Customer. Creative Star Ltd shall not be liable for costs, damages or expenses or any other losses incurred by the Customer or any third party as a result of this action, nor liable in contract or in tort or otherwise in any way whatsoever.

Payment

Invoice are to be raised weekly so both parties know what the cost are and keep payments up to date.

Payments can be made by BACS to the account details provide by Creative Star Ltd, within 14 days of receipt. Payments for services shall be made in full on the agreed payment terms. Interest may be charged on any amount owing after the date at the rate of 8% plus the Bank of England current reference rate per month or part month plus compensation under section 5A of the Late Payment of Commercial Debts (interest) Act 1998 until it is paid in full. Unfortunately we are unable to accept cheques.

In the event that an interim invoice is issued and such an invoice remains unpaid beyond the payment date stated in the said invoice then we shall be entitled to cease works until such time as payment is made in full. In the event of such an invoice remaining unpaid for a period of 14 days beyond issue then we shall be entitled to terminate the contract and to seek payment of any balance due in full. 

Cancellation of Works

In the event of you the Client cancelling the planned works, you agree to notify Creative Star Ltd by phone or email within 14 days prior to the project start. Cancellations 14 days or less before the start date may incur full material cost that have been spent for the works. 

If for any reason Creative Star Ltd is required to postpone the works you will be inform as soon as possible. We will not accept liability in respect of any delay and any such delay will not allow the customer to make any claim in respect of charges, costs or other penalties. 

In the event of exterior decorating works being delayed due to weather then we shall be entitled to bring forward the start date for any interior work instructed by you. In the event that you have not instructed interior work then we may require to start an alternate job which involves interior work and this may delay a result in further delay to allow completion of the alternative work. We shall keep you fully advised in writing in the event that such circumstances occur.

Promise to the Customer

Creative Star Ltd will complete all works to the highest standard. We will do everything possible to ensure a smooth running of the project and that all works are completed within the agreed timescale unless issues are encountered. If any issues are discovered that were not covered in the estimate we will contact you as soon as possible to discuss the possible options and extra costs. Your property will be left clean and tidy once all work is completed. 

On completion, you will be required we walk around with Creative Star Ltd to deem you accept the job is completed to your satisfaction. This can only be done in person and at the time of the completed works.

Customer Services

Any snagging items or defects must be raised within 24 hours of us completing the works. Such defects must be evident under normal lighting conditions and without magnification and from a normal viewing position. Completed snagging lists must be agreed by both the client and us. Once a snagging list has been agreed by the client and ourselves then that shall be deemed to be completed. In the event that we received no intimation of snagging and other defects within 24 hours of completion then it shall be assumed that the job has been completed to your satisfaction and that payment falls due. 

In the event of both Creative Star Ltd and the Client determining that remedial work is required then any outstanding invoices must be cleared to at least 90% before any said remedial works can be undertaken. Creative Star Ltd shall be entitled to attend on site and carry out such remedial works and you shall not have an entitlement to instruct others to carry out such works and seek recovery of cost from ourselves.

Customer Privacy

Creative Star Ltd will never sell or otherwise pass on your contact details to any other Company or Third Party unless required to do so by Law. When you contact Creative Star Ltd your details may be retained to assist with your enquiry and your details may be used for correspondence and for marketing purposes. If you do not wish your details to be used for marketing purposes then please let me know.  

Assumptions

Painted surfaces is complicated and can have different chemical reactions. Creative Star Ltd will do its due diligence in ensuring the products are suitable. But should information not be provided, the history of previous paints used or the condition of the surfaces. We can not be held responsible for reactions that may take place. 

Here is a list of possible situation that may effect your final finish

  • Any work not performed by the Contractor
  • Surfaces made of or containing, galvanized metal, or varnished surfaces
  • Bleeding caused by rust, cedar, or knots
  • Exact paint match, since environmental conditions will affect the colour and finish of all paints over time
  • Cracks that occur in drywall, plaster, artex or wood after completion of painting
  • Repairs which are needed due to results of a defect in the paint (despite paint being supplied by the Contractor or the customer)
  • Any peeling, chipping, or blistering caused by:
  • mill-glazing from smooth cedar
  • peeling of layers of paint existing prior to the work performed by the Contractor
  • moisture content of the substrate (mould)
  • abrasion, abrasive cleaning, mechanical damage, abuse, or damage that results from the use of chemicals (or cleaning agents)
  • exposure to harmful solids, liquids or gases
  • ordinary wear and tear, or extraordinary wear and tear, resulting from improper use and care
  • defects or damages caused by fire, flood, acts of God, explosion, vandalism, extreme weather conditions, alterations, abuse, negligence, misuse, or any additional reason beyond the control of the Contractor
  • structural defects, including settling or movement
  • harm or neglect of the homeowner (including abnormal use or misuse of an area).
